The global war on smoking passed a major milestone on 30 November 2004. On that date, Peru became the 40th country to ratify an international treaty to reduce smoking, thus triggering activation of the treaty in 90 days.

According to the World Health Organization‘s World Health Report 2003, tobacco consumption is the single leading preventable cause of death. It prematurely ends the lives of 5 million people a year, a figure which will double by 2020 if current trends are not reversed. Tobacco is the only legal product that causes the death of one half of its regular users, more than many illegal drugs. This means that of the current 1.3 billion smokers, 650 million people will die prematurely due to tobacco. Another way to look at the effect of smoking is to measure the average reduction in life expectancy among smokers. A study published in the British Medical Journal in June 2004 followed 34,439 male doctors since 1951 and showed that smokers died on average 10 years earlier than non-smokers.

Although the number of smokers has stabilized or fallen in developed areas, it is rising in developing or transitional regions, which contain more of the world’s population and already 84% of the world’s smokers. To fight this increasing health threat, the World Health Organization Framework Convention on Tobacco Control (WHO FCTC) was unanimously adopted by the 56th World Health Assembly in May 2003 following almost three years of negotiations. The treaty aims to reduce both the demand for and the supply of tobacco by setting standards on tobacco price and tax increases, tobacco advertising and sponsorship, labelling, illicit trade and second-hand smoke.

Studies show that increasing prices through taxes on tobacco products is the most cost-effective way to reduce smoking. The World Bank estimated that a 10% increase in tobacco prices would, on average, result in a reduction of 4% of the demand in high-income countries and 8% in lower-income countries. Thus the treaty suggests tobacco taxes or price controls, although it neither suggests specific levels nor requires any taxes or price controls.

The treaty requires all countries adopting it to ban, to the extent allowed by their constitutions, all tobacco advertising, promotion and sponsorship within five years. Health warnings must occupy at least half of the principal display areas of a pack, but they must not be less than 30%. These health warnings must be changed regularly and may include pictures. Cigarette packages must contain information on ingredients and emissions.

The treaty aims to reduce smuggling by requiring adopting nations to mark all tobacco packages for tracing purposes and to indicate their country of destination, as well as to cooperate with each other in monitoring and controlling the movement of tobacco products and investigating their diversion. The treaty bans tobacco sales to and by minors.

The idea for an international instrument for tobacco control was initiated in May 1995 at the 48th World Health Assembly. But it wasn’t until 1999, a year after the then WHO Director-General, Dr Gro Harlem Brundtland, made global tobacco control a priority, that work on the present treaty began. During the year after the FCTC was written, 167 countries signed and 23 countries ratified it, making it one of the most rapidly embraced UN treaties of all time. “The momentum growing around the WHO Framework Convention on Tobacco Control seems unstoppable. It demonstrates the importance placed by the international community on saving many of the millions of lives now lost to tobacco,” said Dr Lee Jong-wook, WHO Director-General. “I look forward to more countries joining the 40 states that are making it possible for this Treaty to become law.”

Of the countries ratifying the treaty, the largest are (in order of decreasing population) India, Pakistan, Bangladesh, Japan, Mexico, Thailand, France, and Burma. Nations that have signed but not yet ratified include China, USA, Brazil, Nigeria, Philippines, Viet Nam, Germany, and Egypt. The largest non-signers are Indonesia, Russia, Colombia, Tanzania, and Uzbekistan. The Himalayan kingdom of Bhutan went beyond the treaty requirements when on December 17 it became the first country in the world to completely ban the sale of tobacco.

Citing violations of its policy regarding “Marine mammal items”, eBay terminated an online listing on Monday by the town of Cape St. George, Newfoundland and Labrador, Canada, for a 40 ft (12 m) sperm whale carcass reportedly beached upon its shores about a week prior.

With an initial asking price of 99 cents, bidding for the carcass reportedly rose to C$238.03 within 15 bids. Reports variously state the final price of the whale, prior to the removal of the listing from the auction site on Monday at about 2:30pm, was C$2,025 or C$2,075. Listed in eBay’s “really weird” category, the carcass was considered by eBay to be an example of “items made from marine mammals regardless of when the product was made”, which are prohibited as per site rules.

Following a council meeting on Sunday in the town of 950 residents, Cape St. George’s mayor, Peter Fenwick, put the whale up on the auction site in a bid to have it removed from the town’s premises, citing a lack of cooperation from provincial and federal government officials on the matter. “It’s your problem, you solve it”, Fenwick recounted to The Globe and Mail (TGaM) as the response he received from them. Apart from eBay, Kijiji was also suggested as another avenue by which to sell the carcass.

Fenwick told CTV News, several years prior another sperm whale measuring 15 ft was beached in the area, but disappeared without incident, an act Fenwick attributed to be the work of Fisheries and Oceans Canada. “This time”, he remarked, “the authorities have told us that it’s our whale, it’s our responsibility to get rid of it.”

On putting the carcass for sale, Fenwick remarked, “We knew we had to do something with it and this seemed to be the least expensive way of disposing of it.” In a news release, Fenwick highlighted a possible use for the carcass, particularly its bones. “The 40 foot sperm whale will make a spectacular exhibit once the fat and muscle is removed, and the town is asking museums and other organizations that could use a whale skeleton to contact the town for further details.”

On retaining the whale himself, Fenwick stated, “As a town we would dearly love to keep the whale and put it on exhibit in the town but the cost of such a venture would be hard to justify.” Fenwick told TGaM the whale was “in half decent shape”. “This one looks like it died very recently and hasn’t decomposed much”, which Fenwick suggested elsewhere was due to the whale’s present location, partially submerged in near-freezing water. However, Fenwick noted its close proximity to a residential area, saying homeowners who lived there were “very interested in seeing the whale gone.”

eBay was not the only organization who barred the sale from taking place. “We also got threatened by the federal department of the environment, and told to pull the ad off or they would prosecute us”, said Fenwick on the opposition he said he received from Environment Canada, which viewed the sale as contravening a federal act designed to protect endangered species. “I received a call from the federal department of the environment saying that you’re not allowed to sell any parts of sperm whales, even if they’re dead.” he added. “So I said, ‘Oh that’s very good, I’m glad to hear that, now can you send somebody over here to get rid of it for us?'” Fenwick’s request was met with a negative response from Environment Canada.

“They’ve got to sort it out somehow. The uncertainty means it just sort of sits there and rots.” Once decomposition sets in, Fenwick remarked the carcass would become a “real nuisance”. “I don’t know if you’ve ever seen a whale that’s been rotting on the beach for a couple of months — actually sometimes you can’t see it for the clouds of flies around it — but you can smell it for about a mile”, he added.

On finding alternate means to dispose of the carcass, Wayne Ledwell, a member of Newfoundland’s Whale Release and Strandings, suggested the whale be towed out to a remote area. “They need to do that right away, when they come in and they’re fresh,” said Ledwell. “No one wants to go touch them … everything becomes gooey and slippery and you can’t stand up on the whale and it gets on your boots and you can’t get the smell off and then you go home and the dog rolls in it and you get it in your kitchen and you curse the whales, and you curse the government and … it becomes a mess.” Fenwick said they’d considered the idea, enlisting a local fisherman who, however, judged his engine too small for the job.

Previously, blue whale carcasses washed ashore in the towns of Trout River and Rocky Harbour, located about 150 km further north, and were taken by Royal Ontario Museum for preservation of the skeletons. Fenwick suggested the sperm whale carcass in his town might also meet a similar fate, as the sperm whale’s status as the largest toothed whale might prove to be a drawing attraction for such a facility.

Regarding what he plans to do next with the carcass, Fenwick said “If we’re not allowed to sell it, we’re willing to drop our 99 cent price down to a zero.” He said he hoped some eBay bidder stays interested in the whale. “We’ll be glad to talk to them about giving them the whale. We’re hoping that’s not illegal.” He also said he hoped the publicity from the town’s predicament, which garnered national attention, and its unusual means of finding a solution, would draw in someone interested in taking the whale off his hands at their own expense.

Should the whale fall under new ownership, Fenwick advised it be moved away from the town to a beach devoid of people, and the blubber left as food for seagulls, insects, and other predators. He estimated “It’ll probably take a year or so to get down to the skeleton.” As monetary gain was reportedly not what the town cared about, Fenwick was willing to offer the carcass for free, though one report noted money raised from the listing could have gone towards the building of a skate park.

Yesterday, the United States House of Representatives voted to effectively reject the Senate version of a bill, passed with bipartisan support, to extend a payroll tax cut two months past its year-end expiration date. The House voted instead to create a conference committee to settle differences between members of both bodies.

Although the tax cut extension itself has support among Republicans and Democrats, lawmakers disagree on how Congress should go about compensating for the cost of extending the cut and the policy changes it would entail.

During an appearance yesterday, President Obama condemned opposition to the Senate-passed version of the bill, accusing Republicans in the House of trying to negotiate on matters unrelated to the bill. Republicans, in response, say there is still time to negotiate the bill, insisting that lawmakers ought to concentrate on a year-long plan rather than a two-month extension. Senate Democratic leader Harry Reid, however, says he will not agree to negotiate the tax cut extension until the Senate-approved bill is passed by the House.

If the tax cut is not extended and instead expires on December 31, approximately 160 million Americans will be affected by the tax increase; President Obama insists the only way to prevent the tax hike beginning January 1 is for the House to pass the Senate bill. In response, House Speaker and Republican John Boehner wants Obama to “call on the Senate to return” to negotiate. The Senate, shortly after passing the bill, adjourned for the Holiday break.

Also included in the bill is a provision that would require President Obama to make a decision regarding the construction of the Keystone XL pipeline, a pipeline that would transport oil from Canada to Texas.

House Democratic leader Nancy Pelosi blamed the congressional year-end impasse on “Tea Party Republicans.” In a letter to President Obama, Speaker Boehner requested he galvanize the Senate to negotiate on the bill’s provisions, writing “The differences between the two different bills can be quickly reconciled to provide the American people the certainty of a full-year bill. There are still 11 days before the end of the year, and with so many Americans struggling, there is no reason they should be wasted. You have said many times that Congress must do its work before taking vacation”.

A survey, conducted by the Patients’ Association, an independent charity devoted to defending the interests of patients, has revealed “unease and concern among health professionals” that infection control practices in the United Kingdom’s National Health Service are “endangering patients’ lives”. The survey published today, revealed that NHS infection control staff felt that infection control was inadequately financed, that training was inadequate and that much time has to be spent reassuring patients.

The Association is concerned that the financial deficits of many NHS trusts may prejudice good infection control practice because the resources allocated for this are not effectively ring-fenced. There was evidence of inadequate training and execution of good practice. The report also listed shortcomings in way supplies were acquired and delays in getting supplies of the preferred disinfectant: 2% Chlorhexidine-based solution.

BBC reported that a recent paper to a Society for General Microbiology conference by a University of Leeds team has shown that two chemical cleaners commonly used in hospitals, far from reducing the prevalence of Clostridium difficile (C. difficile) bacterium, actually increased its ability to survive. Only cleaners containing bleach had been proved effective in disposing of this bacterium. Authors of the paper refused to disclose what those two cleaners were.

There is particular concern in the Patients’ Association about the absence of adequate data on the spread of C. difficile. The Telegraph quotes Katharine Murphy, of the Patients’ Association, as saying: “Collection of data about this very dangerous infection is haphazard to say the least, and we are not getting the true picture. How can patients have confidence in their hospitals if the real threat posed by C. difficile is being played down?”

The Report found that only a fifth of respondents confirmed the collection of surgical-site infection data and that only 27% reported infection data about C. difficile; despite the requirement that Trusts collect and report these data.

Trusts are also required to report the incidence of surgical-site infection, but the Patients’ Association survey found that only a fifth of respondents confirmed the collection of these data.

The Patients Association called this a “worrying and haphazard situation”.

The Telegraph reports that experts consider that C. difficile is an even greater threat to patient’s health than MRSA.

Leicester NHS Trust has reported 49 deaths associated with C. difficile. in three of its hospitals. Six deaths have been reported at Maidstone Hospital and the Healthcare Commission has been asked to investigate. C. difficile was associated with the deaths of nearly 1000 patient in 2003.

A new Code of Practice “for the prevention and control of healthcare associated infections” was issued by the Department of Health in October 2006 under the Health Act 2006. This refers to the NHS in England and Wales only.

The search engine Google announced the removal of the official German BMW web site from its search results today. Google is reported to have removed the website due to the use of a trick to raise its website ratings in the search engine’s results.

The online version of Forbes magazine reported that the German word for used car, Gebrauchtwagen, appeared 42 times in a doorway web page created by the German car manufacturer. Doorway web pages contain many keywords designed to attract search robots. The page presented to Google’s robot for indexing was significantly different from the page presented to the site’s visitors.

According to a recent blog post by Matt Cutts, one of Google’s software engineers, this technique is “a violation of our webmaster quality guidelines.” These guidelines encourage webmasters to “avoid tricks intended to improve search engine rankings.”

BMW reacted to the measure by claiming that it had no intention of manipulating the search results, but instead used the doorway pages with the objective of “offering a better service” to those looking for used cars.

Australian Transport Safety Bureau announced that an oxygen cylinder which was located near the area of the explosion on Qantas flight QF30 from London, England to Melbourne, Australia was unaccounted for but said that it was too early to say that an oxygen cylinder could be the cause of the mid-air explosion. It did say it had ruled out explosives as a cause stating that they “found no indication of explosives”.

The Civil Aviation Safety Authority has ordered Qantas to check all oxygen cylinders and the brackets which hold them on its Boeing 747s, but hasn’t ruled out that the order will be extended to all of the Qantas fleet.

In a press release earlier today, New York State Agriculture Commissioner Patrick Hooker, along with Dean of Cornell University’s College of Veterinary Medicine Donald F. Smith, confirmed that scientists at the New York State Food Laboratory identified Aminopterin as a toxin present in cat food samples from Menu Foods.

Menu Foods is the manufacturer of several brands of cat and dog food subject to a March 16, 2007 recall.

Aminopterin is a drug used in chemotherapy for its immunosuppressive properties and, in some areas outside the US, as a rat poison. Earlier reports stated that wheat gluten was a factor being investigated, and officials now state that the toxin would have come from Chinese wheat used in the pet food, where it is used for pest control. Investigators will not say that this is the only contaminant found in the recalled food, but knowing the identity of the toxin should assist veterinarians treating affected animals.

The Food Laboratory tested samples of cat food received from a toxicologist at the New York State Animal Health Diagnostic Center at Cornell University. The samples were found to contain the rodenticide at levels of at least 40 parts per million.

Commissioner Hooker stated, “We are pleased that the expertise of our New York State Food Laboratory was able to contribute to identifying the agent that caused numerous illnesses and deaths in dogs and cats across the nation.”

The press release suggests Aminopterin, a derivative of folic acid, can cause cancer and birth defects in humans and can cause kidney damage in dogs and cats. Aminopterin is not permitted for use in the United States.

The New York State Food Laboratory is part of the Federal Food Emergency Response Network (FERN) and as such, is capable of running a number of unique poison/toxin tests on food, including the test that identified Aminopterin.
